What is probate? Probate is the settling of your loved ones estate. The family, with the help of the attorney, can do the same things your loved one could do with their property if they were still alive: manage bank and investment accounts, sell cars, transfer titles, pay bills, etc. Idaho was the first state to adopt the simplified code.

What if I don't have enough money for my mom's funeral? In almost all cases, you are not personally obligated for your mother’s debts. If your mother owned enough property to pay for her funeral, we can usually make arrangements with the funeral home to make payment from the estate settlement. This is true even if your mom’s debts exceed the assets she left behind. Zero Down Probate is designed to settle the account without obligating you to pay the bills.

If I get involved, will I become responsible to pay mom's debts? As a general rule, only the assets of your mom’s estate are responsible for her debts. If there are not enough assets to pay all the debts we will arrange for creditors to be paid proportionately, we will seek court approval, and once obtained close the estate with no remaining financial concerns for you to worry about.

What will it cost me to find out if my situation qualifies? It will cost you nothing to come in and discuss settling the estate with us. If your deceased left any assets, even if they left a lot of debt, Zero Down Probate can settle the estate as long as the assets are enough to pay the basic costs and legal fees of the probate. The legal fees will come out of the estate, not out of your pocket. We take care of the creditors at no cost to you unless you shared debt with the deceased.

How much involvement will it take on my part to handle the estate? Our staff at Zero Down Probate will handle as much of the management of the probate as you'd like. At some point the Personal Representative will have to sign letters authorizing our attorneys to deal directly with accounts. Eventually, the Personal Representative will need to sign deeds or titles to complete the estate. Leave the rest of it up to us.
